These Terms govern access to and use of websites, membership information, forms, communications, events, properties, and other services offered by THEMOVE.COMMUNITY LLC ("The MOVE.," "we," "us," or "our"). Additional written terms may apply to a specific membership, event, property, purchase, or program.
1. Acceptance and eligibility
By using our services, submitting a form, creating an account, purchasing access, or participating in a program, you agree to these Terms and any additional terms presented at enrollment, including the Community Code of Conduct. You must be at least 18 years old or have valid authorization from a parent or legal guardian where expressly permitted.
2. Accounts and accurate information
You agree to provide accurate information, protect your credentials, and promptly notify us of suspected unauthorized account activity. Access IDs and membership credentials are personal and may not be transferred unless written rules expressly allow it.
3. Membership and access
Membership may provide communication, participation, or access opportunities described at enrollment. It does not guarantee daily property access, event availability, capacity, specific benefits, or uninterrupted services. Access may change because of weather, safety, maintenance, capacity, scheduling, member standing, or posted rules. The current Membership Agreement governs approved Individual, Household, and Business memberships.
4. No ownership or investment
Membership is not ownership, equity, a security, or an investment. Membership does not guarantee income, profit, rewards, financial returns, or an ownership interest in The MOVE., The Valley, Borderline Crossing, Gifted Eats, or any related property or project. Any contribution-based reward program requires separate written rules.
5. Payments, renewals, cancellations, and refunds
Current prices, billing frequency, renewal terms, taxes, cancellation rules, and refund terms are shown in the approved enrollment process before payment. Those purchase-specific terms control if they conflict with this general section. Third-party payment processors may apply their own terms. Members can stop future renewals through the online cancellation request or the other methods listed in the Membership Agreement.
6. Property, event, and outdoor participation
Outdoor areas and community events may involve water, uneven terrain, weather, tools, vehicles, fire, wildlife, physical activity, and other inherent risks. You agree to follow posted instructions, access limits, waivers, safety requirements, parking rules, guest rules, and staff directions. Participation may be denied or ended when necessary to protect people, property, neighbors, or operations.
7. Community conduct
Harassment, threats, violence, discrimination, unsafe conduct, property damage, unauthorized commercial activity, unlawful behavior, and misuse of access are prohibited. Members and guests must respect the land, facilities, neighbors, staff, and one another. The full Community Code of Conduct applies to members, guests, participants, staff, volunteers, hosts, and partners.
8. Communications and consent
When you submit contact information, you may receive transactional messages about your inquiry, account, access, purchase, event, or safety. Marketing email or SMS is sent only under the consent disclosed on the applicable form. Message and data rates may apply. You may opt out of marketing SMS by replying STOP.
9. Intellectual property
Site content, branding, text, photographs, graphics, and software are owned by or licensed to The MOVE. or their respective owners. You may use public site content for personal, noncommercial purposes but may not reproduce or commercially exploit it without permission.
10. Third-party services and links
Payment services, Gifted Eats, The Valley website, and other linked services may operate under separate privacy policies and terms. We are not responsible for external systems outside our control.
11. Disclaimers and limitation
Services and information are provided on an "as available" basis to the extent permitted by law. We do not guarantee that every service will be uninterrupted, error-free, or suitable for every person. Nothing in these Terms excludes liability that cannot legally be excluded.
12. Suspension and termination
We may suspend or terminate access for nonpayment, unsafe conduct, rule violations, misuse, unlawful activity, operational closure, or other material breach of applicable terms. Obligations that logically survive termination remain in effect.
13. Changes
We may update these Terms as services evolve. The effective date will be updated when material changes are published. Additional notice may be provided where required.
14. Governing law and contact
